The EU Directive on Temporary Agency

The EU Directive 208/104/EC, adopted in 2008 has a dual objective: To ensure the protection of temporary agency workers in Europe and to establish a suitable framework for the use of temporary agency work services. 

The Directive recognises the contribution of agency work to job creation and the development of flexible forms of employment.

It establishes the principle of equal treatment, while for a certain flexibilty based on three forms of derations.

The Directive calls upon Member States to review existing restrictions imposed on temporary agency work and sets clear limits to their justifications. Any existing, unjustified restrictions need to lifted in the implementation phase of the Directive.
 

Eurociett fully supports the Directive and calls upon Member States to use the implementation of the Directive to lift existing, unjustified restrictions faced by the industry.

 

 

The EU Posting of Workers Directive

The Directive on the posting of workers, adopted in 1996, sets basic employment and working conditions of workers posted to another EU Member States. Temporary agency work is explicitly and fully covered by the Directive.
 

Eurociett fully supports the Posting of Workers Directive in its current form, but calls for a better implementation of the Directive, including more effective cooperation between Member States and enhanced information exchange.

 

Introduction

Eurociett is striving for appropriate regulation for the agency work industry.  At international level, Ciett calls for further ratification of ILO Convention 181 on private employment agencies.
 

At European level, the EU Directive on temporary agency work and the Posting of Workers Directive are key elements of European regulation affecting the industry.
